General Terms and Conditions of Chalet Company, Nuremberg

§1 Scope and Definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity (§ 13 German Civil Code – BGB).

§2 Conclusion of Contract, Storage of Contract Text

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our online shop, the following applies: The consumer submits a binding contractual offer by successfully completing the ordering process provided in our online shop.

The order process includes the following steps:

Selection of the desired goods
Confirmation by clicking the “Order” button
Checking the details in the shopping cart
Clicking the “Checkout” button
Logging into the online shop after registration and entering login details (email address and password)
Re-checking or correcting the entered data
Binding submission of the order by clicking the button “Order with obligation to pay” or “Buy”

Before submitting the binding order, the consumer can return to the page where the data was entered by using the “Back” button of their internet browser to correct input errors or cancel the order process by closing the browser. We confirm receipt of the order immediately via an automatically generated email (“order confirmation”). By doing so, we accept your offer.

(5) Storage of the contract text: We store the contract text and send you the order data and our terms and conditions by email. You can also view the terms and conditions at any time at https://chalet-shop.de/agb. Your past orders can be viewed in the customer area under “My Account” → “My Orders”.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The stated prices include statutory VAT and other price components. Any additional shipping costs will be added.

(2) The consumer has the option of payment via PayPal or credit card (Visa, Mastercard).

§4 Delivery

(1) Unless otherwise clearly stated in the product description, all items offered by us are ready for dispatch immediately. Delivery takes place within a maximum of 5 working days.
In the case of advance payment, the delivery period begins on the day after the payment order is issued to the bank, and for all other payment methods on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss or accidental deterioration of the sold goods passes to the buyer only upon delivery of the goods, even in the case of shipment.

§5 Retention of Title

We retain ownership of the goods until full payment of the purchase price has been made.

§6 Right of Withdrawal for Consumers

Right of Withdrawal

Consumers have a right of withdrawal under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.

Withdrawal Policy

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us:

by means of a clear declaration (e.g. a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day we receive notification of your withdrawal.

We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct cost of returning the goods.
